Child receives damages from MIB following road traffic accident.
Miss N was nine years old when she sustained a seatbelt injury to her chest as the result of a head on road traffic accident. Miss N sustained chest pain and bruising which resolved within four weeks. She also suffered psychological injury which continued to trouble her for eight weeks in the form of nightmares and reluctance to travel in a car.
The defendant driver was subsequently convicted of driving without due care and attention and without insurance. In the circumstances the Motor Insurers Bureau agreed to deal with the claim. An offer of damages was put forward by the MIB which were considered too low. Proceedings were issued and the claim eventually settled for £900. This settlement was recently approved at an Infant Settlement Hearing.
Cyclist recovers damages after collision with car
Our client was knocked off his bike by the defendant, who was travelling by car in the opposite direction. The driver took a sharp turn after failing to indicate, and collided with our client who was thrown onto the car's windscreen before landing heavily on the pavement.
Our client sustained a fracture of the right shoulder blade with multiple bruising as well as a graze to the forehead, and shock. After pursuing witnesses and obtaining medical evidence, we secured an early admission of liability and negotiated an award of over £6,000. This included a 'loss of enjoyment element' because the claimant was prevented from skiing during a subsequent family holiday.
Compensation received by two brothers, both children, who were injured after being struck by a car at a bus stop.
Emmott Snell acted for two brothers who were waiting at a bus stop on their way to school when a driver lost control of his vehicle and collided with the bus stop striking both boys.
The defendant admitted they were at fault and supportive medical evidence was obtained. The brothers' claims were settled with each receiving in excess of £1,100.
